1. General

  1.1. INFINITY GIFT CARD (PRIVATE) LIMITED (PV002796616), known as “Infinity Gift Card” acts as a platform facilitating the resale of digital and experiential gift cards from various retailers and experience operators, categorised into Occasional eGift Card and Experience eGift Cards. We exclusively offer digital options, refraining from physical gift cards, and provide a user-friendly web application for crafting and sending eGreetings. Our Infinity Mobile App (“Infinity Mobile App”) and website (www.infinitygiftcard.com) are both completely free to use, with a straightforward simple account creation process being the only requirement.    1.2. To make a purchase, you'll need a valid VISA, MasterCard, American Express, or another approved payment method listed on our platform. Access to our services is granted via email, mobile number or other approved means, depending on your device's specifications.    1.3. Our features include a wide range of functionalities, including buying, sending, redeeming, and receiving gift cards, managing, and storing them on Infinity Mobile App on your mobile device or infinity web application, and periodically receiving special offers. Additionally, you can design, customize, and dispatch eGreetings seamlessly.    1.4. Infinity Gift Card handles payment transactions securely through a third-party PCI-compliant processor, ensuring the safety of your financial information. We never retain any sensitive data, such as credit card details. Our platform serves as a marketplace for purchasing digital gift cards issued by various retailers.    1.5. We recommend that you read these Terms of Service carefully before using a Infinity Gift Card. If you do not agree to these Terms, do not make any purchases from the Websites.    1.6. Infinity Gift Card reserves the right to change or modify these Terms at any time at Infinity Gift Card’s sole discretion. Infinity Gift Card will provide notice of any change or modification by sending you a notification, or by updating these Terms.   1.7. Please contact us at support@infinitygiftcard.com if you have any questions about these Terms or the use of gift cards.   

2. Your Infinity Gift Card Account 

  2.1. In order to use the Services, you will need to register an account. Where an account is created, only one account can be registered and in doing so you agree to:   2.1.1. Submit your own valid e-mail address.  2.1.2. Set up a password.  2.1.3. Ensure that all submitted information is true, accurate and not misleading.  2.1.4. Maintain the confidentiality and security of all aspects and information associated with your account, including your password.  2.1.5. You are responsible for any and all uses of your account, whether or not you have authorised such use.  2.1.6. Keep confidential and secure all aspects of other users’ account information that you may have access to. 2.1.7. Refrain from using the Service for any unlawful or otherwise prohibited activity. 2.1.8. Maintain and promptly update your account information to keep it accurate, current and complete at all times. 2.1.9. Notify Infinity Gift Card if you suspect or discover any illegal, hacking or unauthorised use of your account by contacting us by calling 011 299 1334. 2.1.10. By signing into Infinity Gift Card and creating an account, any misleading, inaccurate, or false personal information will result in Infinity Gift Card reserving the right to  de-activate your account and ban you from using our service in the future.   

3. Your Infinity Gift Card Digital Wallet 

  3.1. Upon account creation, a Digital Wallet is generated automatically. This serves as the central repository for all your Gift Cards, allowing you to check balances, oversee, and redeem your Gift Cards, historical gift card listing as well as review Retailer terms and conditions.    3.2. However, it's important to note that access to and visibility of Gift Card balances are contingent upon the Retailer's discretion. Infinity Gift Card does not guarantee the accuracy of the balances reflected in your wallet.    3.3. When you have redeemed your Gift Card, or the balance is very low, you have the option to delete this card. If you accidentally delete your Gift Card please contact here.   

4. Security

  4.1. We recommend that all users set up a passcode lock on their mobile devices. Since Gift Cards should be treated as cash, adding a passcode to your mobile device will help safeguard them in case of loss. It's important not to share your passcode with anyone. If your mobile device is lost, please contact us as soon as possible so we can promptly suspend your account. However, if someone has already used your Gift Card, regrettably, we are unable to provide assistance.     4.2. Infinity Gift Card is a secure site and mobile application. Infinity Gift Card uses a third-party PCI compliant payment processor, we do not hold any financial information. Retailers’ Gift Cards are linked to their POS systems. Once the amount is redeemed you cannot use that Gift Card again.  

5. Retailers’ Gift Card and Operators’ Experience Gift Cards (Standard Cards) 

  5.1. Gift cards and experience gift cards that you purchase from Infinity Gift Card are issued by participating third-party retailers (“Retailers”) and operators (“Operators”). Your purchase of each Retailer Gift Card and Operator experience gift card are governed by certain terms and conditions established by the issuing Retailer and the Operator in addition to these Terms. Retailers and Operators set expiration dates for Gift cards as well as other restrictions and requirements. Please review all applicable Retailers’ terms and conditions prior to the purchase of any Retailer Gift Card from Infinity Gift Card.    5.2. If you have questions relating to the applicable Retailer or Operator terms, please contact the issuing Retailer. As the issuers of Gift cards, Retailers (and not Infinity Gift Card) are fully responsible for all aspects of their Gift Card programs. Retailers are responsible for all liabilities and costs suffered by you or any other party caused – directly or indirectly – by the Retailer or their products or services. Infinity Gift Card has no obligation to resolve any dispute between you and any Retailer. Infinity Gift Card endeavours to work with reputable Retailers, however Infinity Gift Card holds no liability for the sale of products or services provided to you by a Retailer and Operator.    5.3. In purchasing a Gift Card from an issuing Retailer, you waive and release Infinity Gift Card and its subsidiaries, affiliates, partners, officers, directors, employees and agents from any liabilities arising from or related to any act or omission of a Retailer and Operator. Following the purchase of a Retailer and Operator Experience Gift Card, Infinity Gift Card shall not be responsible or liable to you in the event a Retailer discontinues its Gift cards or is unable to or refuses to redeem a Retailer Gift Card (including for reasons of their insolvency, external administration or forced closure), Neither Infinity Gift Card nor any Retailer is responsible for lost or stolen Gift cards. If you lose your mobile device, please contact support@infinitygiftcard.com immediately so we can cancel or block your Gift Card.   

6. Infinity Smart eGift and Experience Cards (Smart Gift Cards) 

  6.1. The Infinity Smart eGift and Experience Card allows recipients to exchange up to five (5) Retailer Gift Cards of their choice for an equal value in the Infinity Smart eGift Card (accessible through the Service). For clarification, Infinity Smart card or Infinity Experience card can only be exchanged within the same category, whether Occasion Cards or Experience Cards, and cross-category exchanges are not permitted.    6.2. The Infinity Smart eGift Card, as well as the Experience Card, remains valid for 36 months, so it's essential to exchange it for the desired Gift Cards before the expiration of this period.    6.3. By exchanging the Infinity Smart eGift Card or Experience Card for Retailer Gift Cards, you are subject to the Gift Card Terms and Conditions outlined by the Retailers or the Operator. Please review the Terms and Conditions of the Retailers and Operators before proceeding with the exchange.    6.4. Once an Infinity Smart eGift Card or Experience Card has been exchanged, either in full or in part, it cannot be reverted to its original state as an Infinity Smart eGift Card.    6.5. Please note that references to the "Smart eGift Card" also encompass the "Infinity Exchange Card," as these terms are used interchangeably.   

7. Recommended retailer eGift Cards and Operator Experience eGift Cards 

  7.1. A Recommended Retailer eGift Card empowers purchasers to suggest a specific Retailer or Operator eGift Card to their recipients, granting them the flexibility to either receive the suggested Retailer or Operator eGift Card (if available on the Service) or exchange it for an alternative Retailer or Operator eGift Card of equal value (also available on the Service). For clarification, Infinity Smart card or Infinity Experience card can only be exchanged within the same category, whether Occasion Cards or Experience Cards, and cross-category exchanges are not permitted.    7.2. If the Gift Card is a Recommended Retailer eGift Card, it will prominently feature the recommended Retailer or Operator's brand, accompanied by a notice stating "more choice, more joy! Your giftee will be able to choose where to spend their gift." These eGift Cards are issued by Infinity Gift Card upon purchase, not by the recommended Retailer or Operator.    7.3. The Recommended Retailer or Operator eGift Card expires on the date indicated on the product purchase page and in the Infinity Gift Card wallet. Once this expiry date has passed, the Recommended Retailer eGift Card will no longer be valid.    7.4. To confirm your desire to convert the Recommended Retailer eGift Card into a Retailer or Operator Gift Card displayed, you can select "keep this card" in your Infinity Gift Card wallet. Alternatively, you can opt to exchange your Recommended Retailer or Operator eGift Card for another brand by selecting "swap for another brand." In case the displayed Retailer is no longer available on the Service, you can swap it for another participating Retailer or Operator Gift Card of equivalent value.    7.5. Once you've finalized your Gift Card selection and a Retailer Gift Card has been issued, this decision cannot be reversed or refunded, except as mandated by law. The newly issued Retailer or Operator Gift Card will come with a new expiry date, as displayed in the Infinity Gift Card wallet, and will be governed by the terms and conditions of the selected Retailer Gift Card.    7.6. For clarification, Retailer or Operator eGift Cards offering special promotions will not include the swap functionality and are not considered Recommended Retailer or Operator eGift Cards.    7.7. Please note that not all Retailers and Operators participate in the Recommended Retailer eGift Card program, and the list of participating Retailers may change periodically.   

8. Retailers’ Standard Gift Cards and Operators’ Experience Gift Cards 

  8.1. All Gift Cards are subject to availability and Infinity Gift Card reserves the right to impose quantity limits on any order, reject all or any part of an order and to discontinue Gift Card products without notice, even if you have already placed your order.    8.2. All prices are subject to change without notice and the price charged will be the price set out on the Service at the time of your order. The minimum price of a Gift Card sold via Infinity Gift Card is LKR1000.00 and the maximum price of a Gift Card sold is LKR50000.00 (subject to each Retailer). If you purchase multiple Gift Cards on a single day, the total amount that you purchase on all the Gift Cards purchased cannot exceed LKR200,000.00. Gift cards purchased through Infinity Gift Card are available for use within Sri Lanka Only.    

9. Retailors’ and Operators’ Gift and Experience Card for Promotional Purpose.

  9.1. From time-to-time Infinity Gift Card may offer special promotions or offers related to purchases of Retailer Gift cards. The applicable terms of each promotion will be posted on the Terms and Conditions page on the websites and near the description of any such promotion.    9.2. The expiration date for a Retailer Gift Card is displayed on or on the back of the Gift Card, in your Infinity mobile wallet. Please refer to the expiry date to ensure you redeem your Gift Card within the allocated validity period. Unless otherwise stated by the applicable Retailer, Retailer Gift cards are not redeemable for cash.    9.3. Each Gift Card purchased by you will be listed as a separate Gift Card. If you purchase two Gift cards from the same Retailer, your wallet will contain two Gift cards.    9.4. Infinity Gift Card is not responsible if a Gift Card is lost, stolen, destroyed, or used without permission. Infinity Gift Card is not responsible if any Gift Card is rendered unsuitable for redemption through no fault of Infinity Gift Card. If you have lost or misplaced your Gift Card and the balance has not been spent or changed from the original amount, email us at support@infinitygiftcard.com , and we will send you a replacement on the condition that the lost or misplaced Gift Card is registered with Infinity Gift Card and Retailer can confirm the remaining used balance.  

10. Redemption of Gift Cards 

  10.1. Redeeming in a physical store:  10.1.1. To redeem a Gift Card from your digital wallet, simply tap on the Gift Card. The Gift Card will then flip, displaying the barcode, pin number (if applicable), and code. If optical scanners are available, proceed by scanning the barcode.  10.1.2. For optimal scanning, tilt your mobile device to enlarge the Gift Card in horizontal format.  10.1.3. If optical scanners are not available, the cashier may need to manually enter the Gift Card code at checkout.  10.1.4. Alternatively, you have the option to print out your Gift Card. Bring the print-out to the physical store of the Retailer and present it at the time of purchase.    10.2. Redeeming Online Store: 10.2.1. Within your digital wallet, tap on the Gift Card. It will flip to display the barcode, pin number (if applicable), and code. To save the code, tap the “copy” button and paste it into the designated code area on the Retailer's website during checkout.  10.2.2. Please be aware that not all Retailers’ Gift Cards can be used for purchasing goods online.  10.2.3. Prior to purchasing a Gift Card, please review the terms and conditions of each Retailer.  

11. Errors and Complaints 

11.1. While Infinity Gift Card strives for accuracy, occasional errors may arise. We do not guarantee that all descriptions, Gift Card details, Retailer information, or pricing displayed on our Service are entirely accurate, complete, reliable, current, or free from errors. Should an error occur, we will make every effort to rectify it promptly. This may involve correcting your order, or if necessary, cancelling it and refunding any amount charged.   11.2. If we discover an error in the amount of funds loaded, reloaded, received or used for any reason, we are authorised to rectify the error without further notice to you, including but not limited to debiting the equal amount of funds found in error from your Cards available balance. If you notice any error relating to the Card or have a query about the Card, you should initially contact Infinity Gift Card by phoning Customer Support during business hours. If you encounter an issue with a purchase made using the Gift Card or have a dispute with a merchant, you should first address the matter directly with the respective Retailer. Should you be unable to resolve the dispute with the merchant, you may reach out to the Infinity Gift Card Customer Care team during business hours by calling 0112 991 334 or emailing support@infinitygiftcard.com.   11.4. Under certain circumstances, we have the capability to investigate disputed transactions on your Gift Card and endeavour to secure a refund for you. However, our capacity to investigate such disputes on your behalf is subject to specific time frames. Therefore, it is crucial that you notify us promptly upon becoming aware of any disputed transaction.   

12. Your Card, Your Responsibility

  You are responsible for the use and security of your Gift Card. You are accountable for all transactions conducted with your Gift Card, except in cases of our negligence. Safeguard your Gift Card details by ensuring they are viewed in private to prevent unauthorized access and recording of the information. We strongly recommend that all users implement a passcode on their mobile devices.    13. User Conduct    13.1. You are fully responsible for both your actions and the actions of anyone accessing the Service through your account. By using the Service, you commit to preventing any individual using your account from engaging in the following activities in relation to the Service.  13.1.1. Use the Services in a way that may potentially disrupt, hinder, or adversely impact other users' full enjoyment of the Service or that may harm, incapacitate, overwhelm, or compromise the functionality of the Services in a manner contrary to the Terms;  13.1.2. Report content or flag abuse for inappropriate reasons or without valid justification;  13.1.3. Use the Service for any unlawful or unauthorized purpose, or promote, endorse, or engage in any illegal activities;  13.1.4. Suggest any affiliation with us or our endorsement of you or any products/services for any purpose;  13.1.5. Establish an account or share content if the individual is under 15 years of age; 13.1.6. Access or attempt to access another user’s account or Infinity Gift Card without explicit authorisation;  13.1.7. Alter, adjust, manipulate, or replicate the Services;  13.1.8. Employ any interface not provided by us to access the Services or extract data; 13.1.9. Develop third-party applications interacting with User Content or the Services without obtaining prior consent from us;  13.1.10. Evade or attempt to evade any filtering, security measures, or protective features designed for the Services or third parties; 13.1.11. Infringe upon the rights of Infinity Gift Card, our users, or any third party.   13.2. Should your account be disabled, you or anyone operating under your authority are expressly forbidden from establishing another account with Infinity Gift Card. We do not assume any responsibility or liability for user conduct, errors, defamation, or omissions that you might encounter while using the Service. Your use is at your own risk.   

14. Changes to these Conditions of Use 

  We reserve the right to modify these Terms and Conditions time to time. Any modifications to the Terms and Conditions will be accessible at here   

15. Termination of Service 

  Your Infinity Gift Card account and access to its products and services are and will remain solely and absolutely at the discretion of Infinity Gift Card. Infinity Gift Card reserves the right to modify, suspend, remove, discontinue, or restrict access to the Service at any time and without prior notice. Infinity Gift Card will not be liable for any removal or restriction of access to any part or feature of the Service under any circumstances.  

16. Privacy

  Information will be shared with third parties about the Card, or transactions made with the Card as permitted by law, and where necessary to operate the Card and process transactions. Our Privacy Policies are available at www.infinitygiftcard.com/page/privacy-policy.  

17. Limitation of Liability

  You retain certain rights under Sri Lankan consumer legislation that cannot be waived and remain unaffected by these Terms. With the exception of these statutory rights, any conditions implied by other laws are not applicable to these Terms. To the fullest extent allowed by law, Infinity Gift Card will not be held liable for any loss or damage (whether direct, indirect, or consequential) incurred, nor will we be considered in default under these Terms, except in cases of gross negligence on our part. Subject to legal constraints, if we are found liable, our total aggregate liability to you is limited to the remaining monetary value of your Gift Card.  

18. Indemnification

  By using the Service, you agree to defend, indemnify, and hold harmless us, our service providers, and consultants from any actual or potential legal actions, proceedings, claims, damages, payments, deficiencies, fines, judgments, settlements, liabilities, losses, costs, and expenses resulting from or related to your use of the Service, your violation of these Terms, or any content you post, upload, or transmit through the Service. This obligation is at your own expense.  

19. Applicable Law

  These Terms are to be construed and enforced in accordance with the laws of Sri Lanka. Any dispute in connection with a Gift Card is exclusively subject to the jurisdiction of the courts of Sri Lanka.   

20. Waivers

20.1. We are not responsible in cases where you have multiple cards stored on your Digital Waller for payment and inadvertently use the wrong Gift Card. It is your responsibility to ensure that you select the correct card before using your Device for payment.   20.2. We disclaim any liability for the use, functionality, or availability of a Device, the availability of merchants accepting the Device and Gift Card for payment, or any reduction in service due to the failure of third-party communication and network providers.   20.3. Please keep your Gift Card secure. We are not responsible for transactions made on your Card if: a) your Device security measures are compromised; b) you grant others access to, or means of accessing, your Device; or c) any other circumstances in which you enable others to bypass your Device's security measures.   20.4. You are accountable for all transactions on your Gift Card, except those resulting from Infinity Gift Card employees' and/or agents' fraud or negligence. In case of Card loss or theft promptly report it to Infinity Gift Card by calling 0112 991 334.    20.5. The Card carries a value akin to cash and will not be replaced if misused, lost, stolen, or damaged. We may, at our discretion, replace a faulty, lost, or stolen Card. Any replacement Gift Card will hold the same unused value and expiry date as the original Gift Card.   

21. Acknowledgements 

  21.1. Apple, the Apple logo, and iPhone are trademarks of Apple Inc., registered in the U.S. and other countries. Apple Pay and Touch ID are trademarks of Apple Inc. You acknowledge that the provisions above pertain solely to your agreement with Infinity Gift Card and not with Apple, Inc. Infinity Gift Card, and not Apple, bears sole responsibility for Infinity Gift Card’s App and its content. You also recognise that your use of Infinity Gift Card’s App is subject to any additional restrictions outlined in the Usage Rules within the Apple App Store Terms of Service effective at the time of downloading Infinity Gift Card’s App. In the event of any conflict between the terms and conditions of the Usage Rules for the Apple App Store Terms of Service and the Infinity Gift Card Terms of Service, the Usage Rules for the Apple App Store Terms of Service shall prevail.   21.2. The “Android” name, the Android logo, the “Google Play” brand, and other trademarks are the property of Google LLC (“Google”), registered in the U.S. and other countries. You acknowledge that the provisions above relate solely to your agreement with Infinity Gift Card, not with Google. Infinity Gift Card, and not Google, is solely responsible for Infinity Gift Card’s App and its content. You also acknowledge that your use of Infinity Gift Card’s App is subject to any additional restrictions outlined in the Usage Rules within the Play Store Terms of Service effective at the time of downloading Infinity Gift Card App. In the event of any conflict between the terms and conditions of the Usage Rules for the Play Store Terms of Service and the Infinity Gift Card Terms of Service, the Usage Rules for the Play Store Terms of Service shall prevail.    21.3. You acknowledge and agree that Apple and/or Google has no obligation whatsoever to furnish any maintenance and support services with respect to Infinity Gift Card’s App.   

22. Links to Third-Party Websites and Services 

  22.1. We bear no responsibility for the privacy practices or other policies of third-party websites not owned or controlled by Infinity Gift Card. It is your sole responsibility to review and comprehend the policies, terms of use, or services of any other website you visit, whether accessed through the Infinity Gift Card website, App, or otherwise.    22.2. Infinity Gift Card may offer links to third-party websites, apps, mobile services, or other third-party services, and may also present, link to, or provide access to third-party content, data, information, events, apps, or materials (including social media) (“Third-Party Services”) through the Service. Such actions do not imply Infinity Gift Card's endorsement, control, or warranty of any kind regarding those Third-Party Services.   22.3. Users accept and acknowledge that accessing any Third-Party Services is entirely at their own risk. Infinity Gift Card assumes no responsibility for any legal issues or other consequences arising from your use of Third-Party Services, nor for any loss, damage, or harm that may result from such use. Your interaction with these services is not governed by the Terms or Infinity Gift Card’s other terms and policies. It is advisable to review the relevant terms and policies, including privacy and data collection practices. The terms and policies for Third-Party Services are solely between you and the Third-Party Service provider, not Infinity Gift Card.   

23. Disclaimers 

  23.1. Infinity Gift Card operates as a marketplace providing users with access to Gift Cards offered by Retailers and Operators. Acting as an intermediary, we hold no responsibility for the creation or redemption of Gift Cards provided by Retailers, nor can we be held liable for transactions conducted on third-party websites. The use of third-party logos and trademarks does not imply any affiliation between Infinity Gift Card and the third party.    23.2. By using the Service and accessing Infinity Gift Card content, you explicitly acknowledge and accept that such usage is at your own risk. Infinity Gift Card disclaims all warranties and representations, whether express or implied, oral or written, concerning the Service, including:  23.2.1. Implied warranties of merchantability. 23.2.2. Implied warranties of fitness for a particular purpose; and  23.2.3. Warranties of non-infringement or title.    23.3. You are responsible for all transactions conducted with the Gift Card, except in cases involving fraud or negligence by our staff or representatives. If any suspicious activities are detected, we reserve the right to limit or suspend Card usage. It is your duty to regularly monitor your transaction history, keep track of the available balance, and take note of the Card's expiry date. This information, including your transaction history, is accessible through your Infinity Account, located in the wallet section on the website or Infinity mobile App. We reserve the right to amend these Terms and Conditions as deemed necessary. Any updates to these terms can be found on www.infinitygiftcard.com.   23.4. Infinity Gift Card does not warrant that the functions within the Service will be accurate or meet your requirements, nor that the operation of the services will be uninterrupted or error-free.
